(ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that memorial dated 07.09.2018 (Annexure P-2), which he submitted in pursuance to the Regulation 40 of United India Insurance Company (Conduct, Discipline and Appeal) Rules, 2014, has not been decided by the respondents so far. Counsel for the petitioner states that the petitioner had approached this Court by filing CWP No.22635 of 2013, which was decided on 24.08.2018. In the said writ petition, petitioner had challenged imposition of penalty vide order dated 09.05.2013 and the order of the appellate authority dated 30.07.2013, by which an appeal filed by the petitioner was rejected.

CWP-6766-2019 -2While disposing the writ petition, this Court directed the petitioner to avail alternative remedy by filing the memorial under Regulation 40 of United India Insurance Company (Conduct, Discipline and Appeal) Rules, 2014, which he filed on 07.09.2018. Counsel for the petitioner states that no decision has been taken by the respondents so far on the memorial filed by the petitioner on 07.09.2018 and prays that the respondents be directed to decide the same in a time bound manner.

Without going into the merits of the case, the present writ petition is disposed of with a direction to the respondents to decide memorial dated 07.09.2018 (Annexure P-2), filed by the petitioner, by passing an appropriate speaking order, within a period of three months from the date of receipt of certified copy of this order. Present writ petition stands disposed of.
