(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioners in cross case bearing DDR No.31 dated 30.10.2017 registered under Sections 323, 324, 148 and 149 IPC (Section 326 IPC added later on) in case FIR No.216 dated 30.10.2017 registered under Sections 324, 323 and 34 IPC (Section 326 IPC added later on) at Police Station Maur, District Bathinda. Though complainant has not been impleaded as a party, however, Mr. P.K.S. Phoolka, Advocate, has filed vakalatnama on his behalf, which is taken on record, and has strongly opposed the interim anticipatory bail granted to the petitioners by a Co-ordinate Bench of this Court on 18.01.
2018, urging that petitioners, being aggressors, caused injuries to the complainant, who also caused injuries to the petitioners in his self-defence. Complainant party has suffered grievous injuries. Therefore, petitioners are not entitled to the concession of anticipatory bail. Ravinder Singh 2018.07.
-2CRM-M-2075 of 2018 Parvinder Singh, submits that out of the four petitioners, two of them, namely, Jagtar Singh and Sandeep Singh have been found innocent, Jarnail Singh has joined the investigation and is no more required for further investigation. Since no role has been attributed to petitioner Kewal Singh in the instant FIR, therefore, he is not required by the police. Considering overall facts and circumstances, order dated 18.01.2018 granting interim anticipatory bail to the petitioners is made absolute.
