CM-5956-CWP-2021:

This application has been moved with a prayer to prepone the date of hearing in the main CWP No.7517 of 2021 from 25.05.2021 to some earlier date.

Mr. S.S. Pannu, learned Deputy Advocate General, Haryana, has joined the proceedings in pursuance of the copy of this application having been sent to the respondent-State, in advance. He has no objection in allowing this application.

Keeping in view the above-said fact as well as the reasons as mentioned in the application, the same is allowed and the said main CWP is taken on the Board today itself.

[2] CM-5957-CWP-2021:

This application has been moved for placing the Application Form of the petitioner on the record as Annexure P-11. Learned State counsel has no objection for the same. In view of the above-said fact as well as the grounds as narrated in this application, the same is allowed and Annexure P-11 is taken on the record.

CWP-7517-2021:

The petitioner herein seeks the indulgence of this Court for the issuance of a writ in the nature of certiorari quashing the selection of the last candidate under the SC category to the post of Pharmacist vide the result as declared on 19.03.2021 and he has also prayed for the issuance of a writ in the nature of mandamus directing the respondents to appoint him on the said post in the afore-mentioned category, while averring that he has secured higher marks than the said last selected candidate. Learned State counsel has already joined the proceedings on behalf of both the respondents in this case in pursuance of the copies of this petition having been sent to the respondent-State, in advance. Heard.

Learned counsel for the petitioner submits that the petitioner would be satisfied in case a direction is issued to respondent No.2, to consider and decide his representation dated 22.03.2021 (Annexure P-9) within some specific time frame.

Learned State counsel has no objection for the same.

[3] Keeping in view the above-discussed limited prayer of learned counsel for the petitioner and without commenting upon the merits of the matter in hand, the instant writ petition is hereby disposed of with a direction to respondent No.2-The Secretary, Haryana Staff Selection Commission, to consider and decide the above-said representation of the petitioner (Annexure P-9), in accordance with law/relevant rules, by passing a speaking order thereon, within a period of one month from the date of receipt of the certified copy of this order.
