As per the report of the Registry, notices issued to the legal representatives of respondents No.1, 4 and 5 have been received back with the report that they are not residing at the given addresses. Notices issued to respondents No.2 and 3 have been received back with the report that they have expired.

Learned counsel appearing for the legal representatives of the appellant submits that despite making all best possible efforts, he has not been able to establish any contact with the legal representatives of the deceased appellant. Even on the present date, learned counsel has expressed his inability to proceed further in the matter, as he continues to have no instructions or communication from the legal representatives of the appellant. A perusal of the record further reveals that on the previous two occasions, notices issued to appellant No.1(i) and appellant No.1(iii) were served through their brother, whereas the notice issued to appellant No.1(ii) was received back duly served.

In the aforesaid circumstances, it is evident that no useful purpose would be served by keeping the present appeal pending on the docket for an indefinite period.

It, is therefore, appears that the LRs of appellant is not interested in prosecuting the present appeal. 5.
Accordingly, the regular second appeal is dismissed in default for want of prosecution.

However, liberty is granted to the LRs of appellant to seek revival of the appeal in accordance with law, in case any worthwhile cause survives for consideration.
