Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.82 dated 14.08.2014 under Sections 302, 427, 148 and 149 IPC registered at Police Station Sherpur, District Sangrur.

I have heard learned counsel for the petitioners and have gone through the record.

From the record, I find that as per the prosecution version as stated in the FIR, the complainant along with his mother Paramjit Kaur on Bullet motorcycle bearing registration No.PB-13AG-0604 and his father Karamjit Singh @ Ranjha along with grandfather Gurchet Singh @ Harchet Singh on Hero Honda motorcycle bearing registration No.PB-13W-1604, were returning home. CRM No.M-1981 of 2015 -2Nachhattar Singh, Makhan Singh and Happy were sitting, who raised lalkara that Karamjit Singh @ Ranjha has reached and a lesson be taught to him for breaking the legs of Amar Singh. It was about 1.15 P.M. Then Joginder Singh brought the vehicle straight towards Karamjit Singh etc. and hit them with intention to kill them. Complainant's father and grandfather fell on the road. Joginder Singh etc. said that they should not be spared. All the persons sitting on the rear seat stepped out of vehicle and Joginder Singh reversed the vehicle 2-3 times to mow down complainant's father and grandfather. Karamjit Singh @ Ranjha died on the spot and complainant's grandfather was serious and was sent to Civil Hospital, Dhuri and he also died.

The present petitioners have been summoned under Section 193 Cr.P.C. for taking cognizance.

Keeping in view the facts and circumstances of the present case, I do not find that any case is made out to grant anticipatory bail to the petitioners. It cannot be said that only Joginder Singh is liable nor it can be said that it is case of an ordinary accident. Therefore, finding no merit in the present petition, the same is dismissed.
