(Oral) The petitioner prays for grant of anticipatory bail in criminal appeal No.177/2018 arising out of conviction in FIR No.434 dated 18.01.2015 under Sections 279, 338 IPC, Sector 36 Chandigarh. The operative part of the order dated 15.03.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Learned counsel for the petitioner submits that the petitioner faced trial in aforesaid FIR and was sentenced to undergo simple imprisonment for a period of one year along with fine under Sections 279 and 338 of the IPC.
Learned counsel for the petitioner further submits that the petitioner has filed an appeal before the lower appellate Court which is pending and the sentence, awarded to the petitioner, was suspended, however, on 16.01.2019, due to an inadvertent mistake of noting a wrong date as 17.01.2019, the petitioner could not appear MOHD YAKUB 2019.04.25 14:08 I attest to the accuracy and authenticity of this document High Court, Chandigarh
CRM-M No.12048 of 2019 before the lower appellate Court, pursuant to which, his bail/surety bonds have been cancelled and non-bailable warrants have been issued against him.

ASI Mohinder Singh, who is present in the Court, submits that the petitioner, in pursuance to the order dated 15.03.2019, has appeared before the Investigating Officer and has joined the investigation and the petitioner is no more required for further investigation.
In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 15.03.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
