The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 30.06.2000 whereby his representation for further promotion from the date his juniors were promoted has been rejected.

The petitioner joined Haryana Police in District Jind. He was promoted as Head Constable with effect from 15.03.1980 and his promotion was confirmed with effect from 31.01.1986. He made a representation seeking his promotion with effect from 31.01.1985. The respondent considered his request and he was confirmed as Head Constable with effect from 31.01.1985. On the basis of his confirmation as Head Constable with effect from 31.01.1985, he was entitled to further promotion as Assistant Sub Inspector with effect from 31.03.1992 and confirmation of said PARAMJIT KAUR SAINI 2025.04.04 04:45 I attest to the accuracy and integrity of this document

CWP No. 9875-2000(O&M) -2promotion with effect from 31.01.1997 whereas he was actually promoted with effect from 18.11.1993 and confirmed on 31.08.1997. He asserts that his claim was rejected on the ground that District Jind became part of Hisar Range, thus, he was not entitled to seniority as per Ambala Range. The said fact is incorrect because he was part of Ambala Range at the time of his confirmation as Head Constable, thus, his seniority was required to be reckoned from Ambala Range instead of Hisar Range. 3.

Mr. R.K.Malik, Senior Advocate submits that similar controversy has been adjudicated by this Court in CWP No. 11466 of 2000. 4.

Faced with order dated 29.08.2000 passed by a Division Bench of this Court in CWP No. 11466 of 2000, Mr. Raman Sharma, Addl. A.G.Haryana submits that claim of the petitioner would be considered in the light of aforesaid order.

In the wake of statement of learned State counsel, the instant petition stands disposed of. Let the needful be done within six months from today. It is made clear that petitioner would not be entitled to differential salary for the period of service, however, his pension would be re-calculated if it is found that he was entitled to higher rank and higher pay. 6.
