(Oral) The petitioners, both of whom are previously married and whose marriage has not been formally dissolved by a decree of Court and are stated to be living in a 'live-in relationship', have approached this Court seeking issuance of a direction to respondents No.2 and 3, to protect their life and liberty as they apprehend threat to the same at the hands of respondents No.4 to 6, who do not approve of their relationship. The details of the petitioners as mandated to be furnished vide directions issued in CRWP-5777-2021 have been stated in the petition as follows:
- 2 - Details Petitioner No.1 Petitioner No.2 Property Detail Owns 15 Acres of Agriculture Land and One residential house NIL Income Status Rs.20,000-25,000/- per month NIL Marital Status Married with Binder Kaur Married with one Jasswinder Kaur in the year 2010 and they have mutually dissolved their married by way of Panchayati Divorce.
Children Blessed with Two Girls:
1) Girl Namely Neesa Kumari aged about 15 years
2) Girl Namely Anjali aged about 13 years Blessed with One Boy from her 1st marriage aged about 10 years Status of Children Residing with the petitioner No.1 The custody of Boy was taken by her earlier husband of petitioner No.2 and she left her kid at her inlaws house as per the mutual consent.
Having heard the learned counsel for the petitioners and while refraining from making any expression as regards the veracity of the averments made in the petition, the petition is disposed of with a direction to respondent No.2 i.e. the Commissioner of Police, District Jalandhar, to get representation dated 25.3.2022 (Annexure P-3) examined as regards the alleged threat perception of the petitioners and to take necessary action as may be warranted under the facts and circumstances of the case. A copy of this order alongwith copy of the representation dated 25.3.2022 be sent to the Commissioner of Police, District Jalandhar (respondent No.2), so as to enable him to do the needful expeditiously.
- 3 - It is, however, clarified that the aforesaid order is not to be taken as any kind of expression as regards the relationship of the parties.
