Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.54 dated 12.03.2017 under Sections 406/498A IPC, registered at Police Station City Kharar, District SAS Nagar. The petitioner and respondent No.2, duly identified by their counsel, are present in Court.
It is informed that the matter has been amicably resolved between the parties. The petitioner and respondent No.2 decided to part ways and a
-2petition under Section 13B of the Hindu Marriage Act, 1955 shall be filed by them on or before 30.05.2018. A total sum of `3,00,000/- shall be handed over to respondent No.2 in lieu of all her claims - past, present and future qua alimony, maintenance etc. towards the petitioner. A sum of `1,95,000/- has been received by respondent No.2 in terms of the compromise. It is agreed that remaining of the settled amount i.e., `1,05,000/- shall be handed over to respondent No.2 at the time of recording of statements of the parties at first motion itself in the abovesaid proceedings. It is further agreed that the custody of the minor child shall be handed over to the petitioner at the time of filing of the petition under Section 13B of the Hindu Marriage Act, 1955 and steps shall also be taken by the parties for quashing of the abovesaid FIR.
It is submitted that the petitioner has joined investigation and he undertakes to abide by the terms and conditions of the settlement and not misuse the concession of anticipatory bail, if confirmed. Therefore, it is prayed that this petition be allowed.
Settlement/compromise dated 25.05.2018 arrived at between the parties before the Mediation and Conciliation Centre of this Court, furnished in Court today, is taken on record subject to just exceptions. Learned counsel for respondent No.2 verifies the factum of settlement between the parties as above and states that there is no objection if this petition is allowed in view of the compromise. Learned counsel for the State, on instructions from ASI Kewal Singh, verifies that the petitioner has joined investigation and is not involved in any other criminal case. There are no allegations on behalf of the State that the
-3petitioner is likely to abscond, if released on bail. Keeping in view the facts and circumstances as above, specifically the settlement arrived at between the parties, but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 18.04.2018 is made absolute. ( LISA GILL ) May 25 , 2018.
