**** INDERJIT SINGH, J. ( Oral ) Petitioners Anil Bhatia and Sanjiv have filed the present petition under Section 438 Cr.P.C. for grant of anticipatory bail in a criminal complaint No. 426/2015 dated 03.11.2015 pending before the Judicial Magistrate Ist Class, Jalandhar.
Notice of motion has been issued in this case. Mr. Indresh Goel, Advocate has appeared and filed his power of attorney on behalf of respondent No.2.
I have heard learned counsel for the petitioner as well as learned State counsel and counsel for respondent No.2 and have gone through the record.
It is a complaint case. The petitioners are not required for investigation or custodial interrogation. Nothing is to be recovered from them. CRM-M-20810-2016 -2As per the learned counsel for the complainant, the petitioners have already appeared before the trial Court and have been released on interim bail. The trial of the case will take long time. No useful purpose will be served by sending the petitioners to custody.
Therefore, I find merit in this petition and the same is allowed. The interim order dated 10.06.2016 passed by this Court granting interim bail to the petitioners is made absolute.
