This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.325 dated 25.10.2015 registered for the offences under Sections 147, 148, 149, 323, 452, 506, 325 and 307 IPC at Police Station Pundri, District Kaithal.

Notice of motion to Advocate General, Haryana. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

Cr. Misc. No.M-20811 of 2016 (O&M) [2] From the record, I find that though Pardeep is the main accused, who was stated to be armed with a `Jelly' and gave the blow on the head of the complainant, but he has been in custody since 3.12.2015. The petitioner is no more required for any interrogation and investigation purposes. The complainant and injured have already been examined and now there is no chance of tampering with the evidence. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
