Present petition under Section 482 Cr.P.C. for quashing of order dated 12.10.2016, passed by the learned Judicial Magistrate Ist Class, Ludhiana, whereby learned Magistrate closed the evidence of complainant. Learned counsel for the petitioner contended that earlier, crossexamination could not be completed by the counsel engaged by the petitioner.

Perusal of order dated 12.10.2016 reveals that during the entire proceedings, cross-examination was deferred on different dates during a long spell of more than three years but it was not completed and as such, the learned trial Court passed the impugned order even after declaring last opportunity for the purpose on different dates. The plea taken by learned counsel for the petitioner that there was a change of counsel and that necessitated the petitioner for seeking quashing of the impugned order would not be a valid ground. Criminal Misc. No. M-19921 of 2017 sufficient opportunities were given to the petitioner to complete the crossexamination but the matter was delayed for the reasons best known to him and there is absolutely no ground to quash the impugned order.
