The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of order dated 15.05.2000/30.05.2000 (Annexure P-10) whereby respondent No. 2 was granted seniority as Secretary with effect from 01.11.1972 and declared senior to the petitioners.

Mr. Raman Sharma, Addl. A.G., Haryana submits that petitioners as well as respondent No. 2 have already retired, thus, instant petition has rendered infructuous.

Operation of the impugned order was stayed by order dated 01.08.2000 passed by this Court. It appears that on account of stay of impugned order as well as superannuation of petitioners/private respondent, the petitioners have lost their interest to pursue the matter. 5.
In view of the above, the Court is left with no other option except to dismiss the petition for non-prosecution. 6.
Dismissed for non-prosecution with liberty to petitioners to move an appropriate application within three months from today, if cause survives.
