IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CWP-8926-1999 (O&M) Date of decision: 12.05.2022 Rajan Gupta

...Petitioner

Vs.

State of Haryana and others

...Respondents

CORAM: HON'BLE MR. JUSTICE ARUN MONGA

Present:

None for the petitioner.

Mr. R.D.Sharma, DAG, Haryana.

*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of certiorari to quash the selection/result declared on 24.04.1999 (Annexure P-6) for the post of Pharmacist vide which the petitioner was held 'not eligible' on the ground of non-submission of renewal receipts of registration as the same were neither demanded in the advertisementnor in the corrigendum. 2.

Petition was admitted on 31.10.2001.

3.

When called out for hearing, there is no representation on behalf of the petitioner. It seems that by sheer effluxion of time and pendency of the writ petition for more than 22 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same.

4.

In any case, it appears that even on merits, claim of the petitioner is not admissible in view of the following stand taken in para 1 ofthe preliminary submissions, which is reproduced herein below for ready reference: "1.

That according to Note-I of the advertisement No.1/98 dated 07.06.98, the eligibility of the candidates was required to be determined with reference to the last date fixed for receipt of applications. The last date according to the VANDANA 2022.05.16 18:12 I attest to the accuracy and authenticity of this document.

advertisement was 06.07.98 and the petitioner deposited the renewal fee on 11.11.98 and got extended the validity period of registration up to 31.12.98. Therefore, on the closing day i.e. 06.07.98, the petitioner was not having the valid registration and as such he was rightly considered ineligible for the post of pharmacist."

5.

Neither any replication has been filed to the afore noted stand of the respondents nor any additional affidavit of any kind to controvert the same. 6.

In view of the aforesaid, no grounds are made out to interfere. 7.

Dismissed.
