(Oral) Prayer is for grant of anticipatory bail in case having FIR No.88 dated 24.8.2019 registered under Sections 323, 325, 379-B, 34 IPC at Police Station Industrial Sector-29, District Panipat. Counsel for the petitioner submitted that the petitioner who was named in the FIR was found innocent during the investigation but now has been summoned as an additional accused by the trial Court on the application moved under Section 319 Cr.PC. The counsel further submits GAURAV SOROT 2022.08.17 16:29 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-14359-2022 that the petitioner has joined proceedings before the trial Court on the basis of order passed by this Court on 5.4.2022.

State counsel on instructions from ASI Rajesh Kumar has not refuted the aforesaid factual assertions raised by the counsel for the petitioner. State counsel further submits that recoveries had already been effected in this case and that now the petitioner is not required by police for further investigation or for custodial interrogation. In view of the above and without commenting on the merits of the case, present petition is allowed and order dated 5.4.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
