NARESH KUMAR SANGHI, J (Oral) At the outset it is apposite to mention here that the present petition was filed by Dhoop Singh and Shiv Kumar @ Devi. However, in view of the statement suffered by learned counsel for the petitioners, present petition qua petitioner No. 1, Dhoop Singh, was disposed of as having been rendered infructuous, vide order PRASHANT KAPOOR 2015.10.06 18:20 I attest to the accuracy and authenticity of this document

Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Shiv Kumar @ Devi, son of Chand Kishore, resident of Harsa, presently resident of Barwala, District Hisar, who has been booked for having committed the offences punishable under Sections 285, 341, 392, 427 and 506, IPC, and Section 25 of the Arms Act, in a case arising out of FIR No. 325, dated 5.9.2014, registered at Police Station, City, Barwala, District Hisar.
Learned counsel for the State on instructions from SI Ashok Kumar of CIA Staff, Hisar, very fairly concedes that in terms of the interim directions dated 30.7.2015, passed by this Court, the petitioner did join the investigation and his custodial interrogation is not required.
In view of above, present petition is allowed. The interim directions, dated 30.7.2015, passed by this Court are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.PC.
