Prayer in the present petition is for quashing of proclamation order dated 01.04.2023 passed by the learned Judicial Magistrate Ist Class, Kharar, District SAS Nagar, Mohali in Complaint No.NACT No.84 dated 09.03.2020 (138 of NI Act) Computer No.PBSAA10006012020 pending for 14.03.2024 for further proceedings titled as M/s Red Tag Caterer Vs. Rekha Kalsi. 2.

Learned counsel for the petitioner submits that the petitioner has already been acquitted by the learned trial Court vide order dated 18.02.2026. He thus, submits that the petition is rendered infructuous and the same may be disposed of as such. He also submits that vide order dated 15.03.2024 of this Court, to show his bona fide to settle the dispute amicably, the petitioner was directed to deposit an amount of Rs.50,000/- before the trial Court. However, the complainant did not compromise the same and finally, the petitioner has been acquitted. He thus, prays that the amount of Rs.50,000/- deposited before the trial Court be released to the petitioner as per rules. In view of the above, the present petition is disposed of as infructuous. The trial Court is directed to release the amount deposited before it, in favour of the petitioner, as per rules and after due verification.
