SUVIR SEHGAL, J. (Oral) The petitioner is seeking regular bail in FIR No.204 dated 03.09.2018 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Lambi, District Sri Muktsar Sahib.

Learned counsel for the petitioner has placed reliance upon the order dated 05.11.2019 passed in CRM-M-4518 of 2019 titled as 'Rajveer Singh Raju Vs. State of Punjab' to contend that co-accused who was owner-cum-driver of the motorcycle has been granted bail by this Court. He has further submitted that the petitioner is in custody since 03.09.2018.

Per contra, on instructions from ASI Amar Singh, learned State counsel has submitted that the challan has been presented on 04.02.2019 and the charges were framed on 12.02.2019. Since the petitioner is in custody for the last 01 year 04 months, approximately and the trial will take sometime to conclude, no useful purpose would be served by keeping the petitioner behind the bars any further.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.

However, in case the petitioner indulges in any activity akin to one for which he has been convicted, while on bail, the prosecution agency will be at liberty to seek the cancellation of the order granting bail to the petitioner.
