The present petition has been filed under Section 482 Cr.P.C/528 of BNSS for issuance of direction to the official respondents to conduct a fair and impartial investigation, arrest the accused persons, re-medical examination of the petitioner and his brother by the specialist doctors to transfer of investigation to IG, DGP or higher police officials in FIR No.298, dated 20.10.2025, registered under Section 115, 190, 191(3), 351 (2) BNS (Sections 323, 149, 148, 506 of IPC, respectively) at Police Station Hathin District Palwal, Haryana.

Learned counsel for the petitioner submits that for redressal of his grievances, the petitioner has already submitted representations dated 01.01.2026 and 09.02.2026 (Annexures P-2 and P-3, respectively), however, no effective action has been taken thereon by the police authorities till date. Mr. Sushil Bhardwaj, learned Additional Advocate General, Haryana, accepts notice on behalf of the respondent-State and submits that representation dated 01.01.2026 (Annexure P-2) has already been duly considered and that the challan in the aforesaid FIR has also been presented before the competent Court.

After hearing learned counsel for the parties and perusing the record, it transpires that so far as representation dated 01.01.2026 (Annexure P-2) is concerned, the same has already been considered and the investigation in the case has culminated in filing of the challan. Accordingly, the present petition to that extent has been rendered infructuous and is disposed of as such.

With regard to representation dated 09.02.2026 (Annexure P-3), the grievance of the petitioner pertains to threat perception to his life and liberty at the hands of the accused persons. Without expressing any opinion on the merits of the allegations, the present petition to that extent is disposed of with a direction to respondent No. 3 to consider and decide the said representation in accordance with law, as expeditiously as possible. In case any threat perception to the life and liberty of the petitioner is found, appropriate steps be taken forthwith to ensure necessary protection. 6.

It is, however, clarified that this order shall not be construed as granting any immunity to the petitioner from any legal action for any violation of law, if found committed by him.
