CRM-M-20905-2016 This is petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.7 dated 08.01.2016 registered under Sections 420 and 120-B IPC and Section 24 of the Immigration Act, 1983 at Police Station Sector 36, Chandigarh.

Learned counsel states that the allegation in the FIR are primarily against Gagan Chadha that he has duped the complainants of heavy amount of money on the pretext of sending them to Canada and Russia. The petitioner though shown to be the proprietor of the firm, is, in fact, an employee of said Gagan Chadha. CRL. MISC. NO. M-20905 OF 2016 (O&M) -2fraudulent intent and actions. Learned counsel refers to the order dated 20.05.2016 passed in CRM-M-6609 of 2016 wherein the said Gagan Chadha who was allegedly running the immigration firm, has been ordered to be released on bail.

The petitioner is stated to be in custody since 01.02.2016. In view of the totality of the circumstances, the petition is allowed. The petitioner is directed to be released on bail on his furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Chandigarh.
