( ORAL) Learned State counsel has informed that cancellation report has already been submitted in the trial Court and notice to the complainant has also been issued.

Learned counsel for respondent No.2 has informed that respondent No.2, who is complainant has filed a protest petition. Learned counsel for the petitioner has informed that the said protest petition has already been treated as criminal complaint under Section 190 Cr.P.C. by the trial Court and the trial Court is proceeding on the said complaint. Faced with this situation, learned counsel for the petitioner seeks to withdraw the present petition with liberty to challenge the order passed by the trial Court, if so desired, whereby the cancellation report has been accepted and subsequent orders, if any so passed against the petitioner. In view of the above, the present petition stands dismissed as having been rendered infructuous with aforesaid liberty. All pending miscellaneous application(s), if any, stands disposed of.
