(ORAL) Learned counsel for the petitioner contends that husband of the petitioner died on 13.10.2021 while in service. There is no legal impediment in granting family pension to the petitioner but the same has not been granted so far. Precisely for the grievance in question, the petitioner has served a legal notice dated 20.02.2023 upon the respondents .

At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case direction is issued to the respondent No.2 to take note of the pending legal notice in accordance with law and decide the same at the earliest.

CWP No.5377 of 2023 -2In view of nature of order which this Court intends to pass, there is no need to issue any notice to the respondents as no order pre-judicial to their interest is being passed. This writ petition is disposed of by directing the respondent No.2 to take note of the pending legal notice dated 20.02.2023 and decide the same in accordance with law preferably with a period of two months from the date of receipt of certified copy of this order.

This petition is disposed of accordingly.
