The petitioner has filed the present petition under Section 439 Cr.P.C., for grant of regular bail in case FIR No. 63 dated 21.06.2018 registered under Sections 420, 406, 465, 467, 468, 471 and 120-B IPC at Police Station City Fazilka, District Fazilka. Briefly, the aforesaid FIR was registered against the petitioner and his co-accused-Pankaj Pawar, on the allegations that they in connivance with each other cheated various persons by dishonestly and fraudulently inducing them to deliver `1,18,00,000/- for securing them jobs and also fabricated and forged joining letters and ID cards in this regard.

CRM-M-13480-2023 -22023:PHHC:041909 Learned counsel for the petitioner, inter alia, contends that the petitioner has falsely been implicated in the instant case. He further submits that now the matter has been compromised between the parties as per compromise (Annexure P-3). Petitioner is in custody since 26.09.2022. The trial is likely to take long time. No useful purpose will be served by further detention of the petitioner in custody. Therefore, the petitioner may be released on regular bail. Learned counsel appearing for complainant-Lakhwinder Singh, fairly admits that the matter has now been compromised between the parties and he has no objection in case, the present petition is allowed and petitioner be released on regular bail.

Keeping in view the facts and circumstances of the case, custody period of the petitioner and the fact that the matter has already been compromised between the parties, but without commenting on merits of the case, I am of the considered view that the petitioner deserves the concession of regular bail.

Therefore, the petition is allowed and petitioner-Mukesh Kumar, is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate concerned.
