This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in criminal complaint No.179/03-05-2016, SC-61/08-122016 titled "State (through Drugs Control Officer, Rohtak) Versus Raj Kumar Sapra and others" under Sections 18 and 27 of the Drugs and Cosmetic Act, 1940 (summoning under Sections 27(a)/17 of Drugs and Cosmetic Act), District Rohtak, Haryana.

Notice of motion has been issued in this case. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Haryana appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-20095 of 2017 [2] From the record, I find that the petitioner has been summoned in the complaint case by the Court. The present petitioner has appeared before the trial Court and has been released on interim bail. The petitioner is not required for any interrogation or investigation purposes. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 1.6.2017 passed by this Court granting interim bail to the petitioner is made absolute. August 3, 2017.
