Mr. G.S. Jagpal, Advocate, for the petitioner. ***** SUDHIR MITTAL, J. (ORAL) The petitioner seeks quashing of order dated 09.03.2023 (Annexure P-9) passed by respondent No.4 whereby his application for extension of parole has been rejected on the ground that he has no jurisdiction to do so.

Learned counsel for the petitioner has submitted that a perusal of discharge certificate (Annexure P-3) shows that the petitioner is suffering from a serious heart issue and he needs urgent surgical intervention. Thus, his parole deserves to be extended.

The submission cannot be accepted because had that been the situation the petitioner would have taken steps to get himself treated earlier. The discharge summary (Annexure P-3) is of 24.02.2020 and till date, no steps have been taken to get appropriate medical treatment even though the petitioner has been released on parole on a number of occasions. In view of the above, the petition has no merit and is dismissed. The petitioner shall however be at liberty to seek parole afresh on medical grounds after he has surrendered, if his condition is actually very serious.
