H. S. Madaan, J. (Oral) The dispute has since been settled between the petitioner and complainant amicably. Learned counsel for the complainant has admitted that petitioner has paid maintenance upto August 2018 and a demand draft for a sum of Rs.70,000/- has been handed over by learned Senior counsel for the petitioner to learned counsel for the complainant in the Court today.

Learned counsel for the complainant states that complainant has no objection if the petition for grant of pre-arrest bail filed by the petitioner is accepted provided he adheres to the terms and conditions BANITA CHUGH 2018.09.19 15:55 I am the author of this document

CRM-M No. 20152 of 2017 -2incorporated in the statement made by him before the Additional District Judge, Chandigarh on 5.9.2018, in the divorce proceedings. Learned Senior counsel for the petitioner states that of course the petitioner would be bound by the terms and conditions of the settlement regarding which he had made statement before the Additional District Judge, Chandigarh , 5.9.2018. Learned State counsel submits that the petitioner has joined the investigation and the matter has been compromised between the parties. Therefore, the Investigating Agency does not require the custodial interrogation of the petitioner.

It being so, the interim bail granted to the petitioner vide order dated 1.6.2017 is made absolute, subject to fulfillment of conditions envisaged under Section 438(2) Cr.P.C. The petition in that way is allowed.
