NARESH KUMAR SANGHI, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Dilbag Singh, who has been booked for having committed the offences punishable under Sections 419, 420, 467, 468 and 471, IPC, in a case arising out of FIR No.396, dated 12.06.2014, registered at Police Station, Civil Lines, Hisar.

CRM-M-20130-2015 (O&M) -2Surender Kumar, Police Station, Civil Lines, Hisar, submits that the petitioner has joined the investigation but he is involved in some other illegal activities, therefore, he has to be interrogated in that regard.

The submission of the learned counsel for the State that the petitioner has to be interrogated with regard to the other illegal activities of the petitioner can be done even after making the interim directions absolute. Therefore, the present petition is allowed. Interim directions issued vide order dated 19.06.2015 are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2) Cr.P.C.. It is made clear that if the petitioner does not cooperate with the Investigation, then it will be open for the State to move an application for withdrawal of the present concession.
