This is petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.44 dated 25.03.2016 registered under Section 306 IPC at Police Station G.R.P.Jallandhar, District Jallandhar. On 25.12.2015 Mohinder Ram the father of the complainant committed suicide. The FIR has been lodged on 25.03.2016 on the statement of Avtar Singh son of the deceased. In the FIR it has been stated that the father of the complainant remained under depression as he used to receive a number of phone calls. The complainant was informed by his father that the calls were from one Varinder Kumar and Venus @ Anjali (the petitioner).

It is alleged that the deceased used to have lengthy conversations over the phone. On 24.12.2015 at about 8.00 p.m. again a call was received from Varinder Kumar. CRL. MISC. NO. M-21087 OF 2016 -2very disturbed and informed the complainant that Varinder Kumar and the petitioner have made life hell for him. On the next day, i.e., 25.12.2015 at about 7.15 A.M. he left the house leaving behind his mobile. When he did not return a search was launched. They were informed that a person had died in an accident with the train who was identified as father of the complainant.

It is stated that few days after the last rites of the father of the complainant were performed, on checking his passbook it was found that various amounts (i.e. ` 50,000/- was withdrawn on 01.12.2015, ` 80,000/- on 07.12.2015 and ` 90,000/- on 16.12.2015) and the balance in his account was only ` 4936/-. Based on this and the earlier complaints of the deceased it is alleged that Varinder Kumar and the petitioner were blackmailing his father to grab his money and that he committed suicide due to the demands of the petitioner and Varinder Kumar.

Learned counsel for the petitioner states that on perusal of the FIR no case for abetment of suicide is made out. He also states that the FIR was lodged almost three months after the said suicide. The petitioner is in custody since 28.03.2016. The investigation is complete and the challan has been filed. In view of the above, the petition is allowed. The petitioner is directed to be released on bail on his furnishing bail/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Jallandhar. The petition stands allowed accordingly.
