ANIL KSHETARPAL, J(Oral) Counsel for the petitioner after arguing for some time, prays for permission to withdraw the revision petition. In view of the prayer made by counsel for the petitioner, the present revision petition is dismissed as withdrawn. Counsel for the petitioner has submitted that his client would like to file a fresh petition on different ground of eviction and the orders passed by the courts below should not influence subsequent proceedings. In the considered opinion of this court such apprehension (as expressed by learned counsel for the petitioner) is totally misplaced as each petition has to be decided on merits and if the ground on which eviction has sought in the new petition is fresh one, the earlier judgment passed would have no bearing.
