(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case registered against him vide FIR No.50 dated 25.06.2014 under Sections 363, 366-A, 376, 341, 323 and 120-B IPC and Sections 4, 8 of Prevention of Children from Sexual Offence Act, 2012 at Police Station Begowal, District Kapurthala. Admittedly, earlier, petitioner was granted the concession of bail vide order dated April 07, 2015. As he did not appear in the court below on one date of hearing, his bail bonds and surety were cancelled. He was declared a proclaimed offender. Thereafter, petitioner has been in custody for a considerable period.

As the trial is not making any headway, no useful purpose would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kapurthala.
