The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in FIR No.0323 dated 15.11.2023 registered under Sections 307, 324, 506, 34 IPC at Police Station Civil Lines, District Bathinda.

Learned counsel appearing for the petitioner inter alia contends that the petitioner has been falsely implicated in the present case. As per the case set up by the prosecution, the petitioner has inflicted injuries on the complainant due to his objection to certain whatsapp messages to his wife by the petitioner. It is further contended that no such message was sent by the petitioner and nothing on record is available to establish the motive. As such, the entire genesis of the occurrence has become suspicious.

Per contra, Mr. Subhash Godara, Addl. A.G., Punjab, who appears on advance notice, on instructions from ASI Jagsir Singh submits that the petitioner is main accused, who has inflicted injuries with a sharp-edged weapon i.e. axe and one of the injury is on the vital part. Having heard learned counsel for the parties and after perusing the record of the case, this Court does not find any ground to grant anticipatory bail to the petitioner. Consequently, the instant petition stands dismissed.
