The respondent's husband assails the correctness of the order passed by the trial Court while directing him to pay maintenance pendente lite @ 16,000/- per month. The wife is already maintaining all the three ₹ children born out from the said wedlock 2.
The petitioner is serving as a Head Constable in Border Security Force and is drawing a pay of 56,346/- per month. The learned counsel ₹ representing the petitioner contends that out of the aforesaid amount, 17,300/- is endowed as a high altitude allowance which is no more payable ₹ as he has now been posted at Gujarat. Even in that case, the income of the petitioner comes to 39,000/-.
