(Oral) The allegations against the petitioner Kuldeep Singh @ Bainja in this regular bail under section 439 Cr.P.C. are that on 12.9.2014, he along with his co-accused, all armed with iron rods had caused injuries to Avtar Singh, Nachhatar Singh and Harpreet Singh. The contention of the counsel for the petitioner Mr. Tarundeep Kumar that there is no specific injury attributed to the petitioner is conceded to by the learned State counsel and the main injury which is on the head though as has been argued is grievous in nature but Mr. Brar has admitted that there is no medical evidence to support the same. No. M-20194 of 2015 (O&M) -2- Without going into the merits of the case, in the light of the fact that trial is not likely to conclude in the near future and the petitioner is in custody since 13.9.2014, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Kapurthala. The present petition stands disposed off accordingly.
