The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 (1) (ia) (ib) (iii) of the Hindu Marriage Act i.e. HMA-38-2024, titled 'Kamalpreet Singh Riar Vs. Sukhleen Kaur', filed by the respondent-husband, pending in the Family Court, Gurdaspur and she seeks transfer of the same to the Court of competent jurisdiction at Patiala.

In pursuance of the notice issued, the respondent made appearance through counsel. However, counsel for the respondent had made a statement that he does not want to file reply, though, he contests the transfer application.

From the material brought on record, it is evident that both the applicant as well as the respondent, are doctors by profession. The applicant is stated to be working as Medical Officer in the Pathology Department and is posted at Moonak, District Sangrur. Counsel for the respondent has disclosed that the respondent is working as Medical Officer and is posted at Civil Hospital, Amritsar. The distance between Patiala and Gurdaspur is stated to be about 250 kms.

Moonak, where the applicant is posted, is situated in District Sangrur and it is at a distance of about 70 kms. from Patiala, the parental place of the applicant. It is stated by the counsel for the applicant that applicant is making up and down every day from Patiala to Moonak. Considering the distance between the two places and also taking into consideration the taxing profession of both the applicant as well as the respondent, an offer was made by the Court, if the divorce petition could be transferred to Ludhiana, which is almost equi-distant for both the applicant as well as the respondent. The same is acceptable to counsel for both the parties.

Thus, considering the distance as well as taxing profession and watching interest of both the applicant as well as the respondent, the transfer application, as such, is hereby partly accepted and the petition under Section 13 (1) (ia) (ib) (iii) of the Hindu Marriage Act i.e. HMA-382024, titled 'Kamalpreet Singh Riar Vs. Sukhleen Kaur', filed by the respondent-husband, stands transferred from the Family Court, Gurdaspur, to the Court of competent jurisdiction at Ludhiana. The requisite record of

TA-274-2025 -3the aforesaid case be sent by the Family Court, Gurdaspur, to the District and Sessions Judge, Ludhiana.

Learned District and Sessions Judge, Ludhiana, shall assign the said petition to the Family Court, Ludhiana. Even, the parties are directed to appear before the Family Court, Ludhiana, within a period of one month from today onwards.
