The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 3 and 4 to issue him passport.

The petitioner vide application dated 05.01.2024 has applied for issuance of passport. The petitioner was embroiled in three FIRs. FIR No. 160 dated 12.09.2019, under Sections 323, 324, 326, 148, 149 of IPC, registered at Police Station Majitha, District Amritsar stands quashed by this Court vide order dated 10.05.2023 (Annexure P-5). Matter emanating from FIR No. 303 dated 04.12.2020, under Sections 307, 241, 336, 506, 34 of IPC and Sections 25, 27 of the Arms Act, 1959, registered at Police Station Majitha, District Amritsar has been compromised and police has not filed its PARAMJIT KAUR SAINI 2024.04.03 05:11 I attest to the accuracy and integrity of this order/judgment.

report. FIR No.63 dated 27.04.2020, under Sections 456, 436, 427, 120-B of IPC, registered at Police Station Majitha, District Amritsar is still pending and police have not filed its report.

Mr. Shubham Mehta, Advocate, inter alia contends that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. . 4.

Mr. Aman Dhir, DAG, Punjab, confirms that till date challan has not been presented against the petitioner. 5.

Ms. Sehej Sandhawalia, Advocate, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within eight weeks. 6.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 25.04.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within eight weeks from 25.04.2024.
