RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No61 dated 03.07.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (Section 29 of the NDPS Act added subsequently) at Police Station Harike, District Tarn Taran, Punjab. According to the prosecution, 1800 Alprazolam tablets and 1000 Tramadol tablets were recovered from the possession of the petitioner. Further, on his disclosure statement, 1380 Alprazolam tablets, 650 Tramazol tablets, 200 Narfloxacion and Tinedazole tablets, 400 loose white coloured tablets, 600 injections and 59 vials were also got recovered. Learned counsel inter alia contends that petitioner has falsely been implicated in the aforesaid FIR. He is a licensed chemist. Tablets recovered from him were purchased by the petitioner for selling purposes. Petitioner is innocent. He is in custody since 27.02.2019. -2CRM-M-12520 of 2019 trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.
On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
