Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0040 dated 25.03.2018 under Section 420 IPC, registered at Police Station City, Nawanshahr, Distrct Shaheed Bhagat Singh Nagar.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. As per allegations in the FIR, present petitioner has taken a sum VINEET GULATI 2018.08.01 16:50 I attest to the accuracy and authenticity of this document Chandigarh of `90,000/- each from two persons on the pretext of sending them to Dubai

CRM No.M-21237 of 2018 -2for employment but he sent them to Dubai on tourist VISA for a period of 25 days.

Learned counsel for the complainant contended that a compromise has already been effected between the parties. The petitioner is not required for investigation or custodial interrogation. No useful purpose will be served by sending the petitioners to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and order dated 17.05.2018 granting interim bail to the petitioner is made absolute. However, he shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
