Mr. Sanjiv Gupta, Advocate for respondent No. 2. RAMENDRA JAIN, J. (ORAL) Despite the case having been called twice, the petitioner has gone un-represented.
Learned counsel for respondent submits that earlier similar petition bearing CRM-M-14518-2016, filed by the petitioner was simply dismissed as withdrawn vide order dated 10.07.2017, without any liberty to file fresh one. Therefore, the instant petition is not maintainable. More so, the petitioner had also filed revision against the impugned summoning order dated 05.06.2013 (Annexure P-2) which was dismissed by the Revisional Court, vide order dated 11.04.2017 (Annexure P-3), against which the petitioner had filed aforesaid CRM-M-14518-2016 and withdrew the same.
In view of the above the instant petition is dismissed on two counts i.e. being not maintainable and for want of prosecution as well.
