(ORAL) Learned counsel for the petitioner argued that in the present case, the husband of the petitioner namely Satyawan, who was working as PTI Teacher and had rendered approximately 5 years of service, unfortunately died on 11.07.2005 but the petitioner is not being extended any benefit under the Haryana Compassionate Assistance to the Dependants Government Employees Rules 2006 despite her entitlement. Learned counsel submits that though, the matter is being kept alive by the respondents within the department, but no benefit has been released to the petitioner and that too without any valid justification. Learned counsel further submits that the petitioner has been submitting representation in this regard with the respondent-department and such representation dated 09.10.2017, has been appended as Annexure P-8 ANJU 2022.04.06 12:12 I attest to the accuracy and integrity of this document Chandigarh

CWP-6817-2022 and the petitioner will be satisfied, at this stage in case a time bound direction is given to the respondents to decide the said representation by passing an appropriate speaking order.

Notice of motion.

On asking of the Court, Mr. Raman Kumar Sharma, Addl.A.G., Haryana, accepts notice on behalf of the respondents. Learned counsel for the respondents raises no objection in deciding the representation dated 09.10.2017 (Annexure 8) in a time bound manner by passing an appropriate speaking order. Without commenting upon the merits of the case or about the entitlement of the petitioner for the benefit which has been claimed by her in the representation dated 09.10.2017 (Annexure P-8), the present writ petition is disposed of with a direction to respondentNo.3 to decide the representation dated 09.10.2017 (Annexure P-8) within a period of eight weeks from the receipt of copy of this order. In case, it is found that the petitioner is entitled for the monetary benefits after the decision upon the representation dated 09.10.2017 (Annexure P-8), the same shall be paid to the petitioner within four weeks thereafter.
