Learned counsel for the State submits that in the present petition, the prayer is for setting aside the order dated 02.06.2014 passed by learned Judicial Magistrate Ist Class, Jalandhar, whereby, respondent No.2 i.e husband of the petitioner/complainant was permitted to visit the foreign country and come back to India on or before 29.11.2014 and thereafter, to appear before the court below on 05.12.2014. He, after obtaining instructions from ASI Jagjit Singh, Police Station, Women Cell, Jalandhar, further contends that on 28.11.2014 respondent No.2 did appear before the court below and got his SEEMA RANI 2015.01.07 16:33 I attest to the accuracy and authenticity of this document Chandigarh

Criminal Misc.No.M-20392 of 2014 [2] presence marked, therefore, it is clear that he had come back from abroad and as such, the present petition has been rendered infructuous.
