The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner was embroiled in two FIRs. In FIR No. 117 dated 17.10.2015, under Sections 323, 325 of IPC, registered at Police Station Cantt. Ferozepur, he was acquitted vide judgment dated 01.12.2016 passed by JMIC, Ferozepur. In FIR No. 20 dated 07.03.2008, under Sections 392, 34, 120-B of IPC and Sections 25, 27, 54, 59 of the Arms Act, 1959, registered at Police Station Cantt. Ferozepur, he was convicted for the period already undergone vide judgment dated 02.05.2012 passed by JMIC, Ferozepur. The petitioner vide application dated 18.09.2023 has applied for passport, however, till date passport has not been issued. Mr. Ashutosh Dhankar, Advocate for Union of India, who on advance notice is present in Court, accepts notice and waives service. He submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order within six weeks, in accordance with law.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 09.04.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 09.04.2024.
