(ORAL) 1.
Through the instant petition, cast under Section 482 of the Cr.P.C., the petitioner claims for a direction, being made, upon respondents No. 2 and 3, to hold an untainted, and, fair investigation into the petition FIR. 2.
However, since the learned State counsel, on instructions given to him by ASI Roshan, submits, that the investigations into the petition FIR, have been concluded, and, that the investigating officer concerned, has instituted a report under Section 173 Cr.P.C., before the learned Magistrate concerned. Therefore, when the above prayer is amenable for its being accepted, only when the investigations were underway, and, is not amenable for acceptance after the conclusion of the investigations, as has happened in the instant case. Consequently, the above prayer does not survive, and, is denied. 3.
In consequence, there is no merit in the petition, and, is hereby dismissed.
