!"#$"% & ' ()) TRIBHUVAN DAHIYA The petition has been filed inter alia seeking a writ of certiorari quashing the order dated 20.02.2025, Annexure P-12, whereby the petitioner's period of absence from 20.01.2015 to 08.10.2015, has not been counted for grant of Assured Career Progression (ACP) scale, though the period was ordered to be treated as leave of kind due/Extra Ordinary Leave (EOL) vide order dated 27.03.2017, Annexure P-5. 2.

It is undisputed that the petitioner remained absent from service for the aforementioned period, and as per the Haryana Civil Services (Leave) Rules, 2016, 'extra ordinary leave' means a leave during which no leave salary will be admissible, except house rent allowance upto first 180 days of spell of leave availed at a time. The essential requirement to get benefit of ACP scale under the Haryana Civil Services (Assured Career Progression) Rules, 2016 is regular satisfactory service. Since the petitioner was on extra ordinary leave during the said period, she cannot be taken to have rendered regular satisfactory service. Accordingly, no exception can be taken to the respondents' action in not considering the same for grant of ACP scale to the petitioner. 5.
