PANKAJ JAIN, J. (ORAL) Present petition has been filed under Article 226/227 of the Constitution of India claiming that the statutory appeal filed by the petitioner is pending with the appellate authority since 1st of January, 2023 and yet the punishment order appealed against is being given effect to and the respondents are proceeding with the recovery. Counsel for the petitioner at the outset prays for deciding the appeal filed by the petitioner dated 1st of January, 2023 (Annexure P-2) expeditiously by passing a speaking order within a time bound frame. Notice of motion.

Mr. Anil Sharma, Advocate appears and accepts notice on behalf of the respondents. He submits that the appeal filed by the petitioner shall be decided expeditiously.

CWP-5248-2023 -2Keeping in view the innocuous prayer made in the present writ petition, the appellate authority is directed to consider and decide the appeal dated 1st of February, 2023 (Annexure P-2), in accordance with law, by passing a speaking order as expeditiously as possible preferably within a period of six months from the date of receipt of certified copy of this order. Till the appeal is finally decided, no further recovery shall be effected from the petitioner.
