**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 94 dated 12.3.2018 registered at Police Station Barwala, District Hisar under Sections 354-A, 354-D, 452 IPC and Section 12 of Protection of Children from Sexual Offences Act, 2012 and Section 3(1) (xxix), 3(1) (xxiii) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Counsel for the petitioner contends that the allegations in the FIR are that the petitioner started laughing on the complainant's face who is a 12 year old girl and further the allegations are that on 11.3.2018 at 9.00 P.M., he came to their house and offered to get matrimonial alliance with a boy of a Jat family on which the complainant's mother started abusing him and he ran away. Counsel further submits that in the Kalandra (Annexure P-2), there is a different version which is contrary to the version given in the FIR. The counsel states that they give an undertaking that he would not venture near the house of the complainant nor will make any attempt to tamper with evidence.

Challan has been filed. Investigation stage is over. Without commenting anything on the merits of the case and in view of the undertaking given by the petitioner, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate on the undertaking that he will not venture near the house of the complainant nor make any attempt to tamper with evidence directly or indirectly.
