This is petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in FIR No.47 dated 30.01.2016 registered under Sections 307, 323, 506 read with Section 34 IPC at Police Station City Rohtak, District Rohtak.
The FIR war registered on the statement of Manjit son of Late Ranbir on the allegations that on 28.01.2016 his brother Sandeep had gone to duty from his house. He was informed that some boys were beating his brother in front of Manu Gas Godown. When he went to the spot he saw Amit, Jassi, Bholu (petitioner) and Rozy were beating him. Amit was stated to be armed with iron rod and Jassi with Danda. The petitioner fled away after extending threats that he would not be spared on another occasion. CRL. MISC. NO. M-21333 OF 2016 -2Learned counsel for the petitioner states that even as per the statement of the injured, the petitioner is only alleged to have been attributed danda blow on the foot and back of Sandeep. The petitioner is in custody since 04.03.2016. Investigation of the case is complete. The Challan has been filed. In these circumstances, without commenting anything on merits of the case, I deem it a fit case for granting bail to the petitioner. Accordingly, the petitioner is directed to be released on bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Rohtak.
