The brief facts of the case are that the petitioner was appointed on the post of driver on daily basis w.e.f. 18.04.1991 in Punjab School Physical Education Development Fund Committee and his services were regularized vide order dated 16.11.1992 (Annexure P-1).

Learned counsel for the petitioner submits that in light of the notification dated 07.08.2012 (Annexure P-2), the employees of the Punjab School Physical Education Development Fund Committee were -1-

entitled to be merged in the Directorate, Education Department against the vacant post, as such, the posts of the petitioner i.e. driver was to be merged in Directorate, Education Department cadre. 4.

In regard to the contention raised by learned counsel for the petitioner is concerned, a perusal of the notification dated 07.08.2012 (Annexure P-2) would show that the action was to be taken to merge the employees of the Punjab School Physical Education Development Fund Committee in the Directorate, Education Department cadre, against the vacant posts, as per the Government rules and instructions issued. A perusal of the impugned order dated 19.12.2024 (Annexure P-11) would show that it is the specific stand of the respondent that after the issuance of notification dated 07.08.2012 (Annexure P-2), no policy/instruction was framed by the State, as a consequence of this, no employee/employees working under the Punjab School Physical Education Development Fund Committee was ever absorbed in the Education Department after the issuance of abovesaid notification.

Taking into consideration the fact that no instruction was issued after the issuance of the notification dated 07.08.2012 (Annexure P-2) in regard to merger of employees of the Punjab School Physical Education Development Fund Committee in the Directorate, Education Department cadre and no employee working in the Punjab School Physical Education Development Fund Committee has been absorbed in the Directorate, Education Department, as such, the claim of the petitioner to merge the post of petitioner i.e. driver from the Punjab -2-

School Physical Education Development Fund Committee in the Directorate, Education Department cannot be accepted. As such, this Court finds no infirmity or illegality in the impugned order dated 19.12.2024 (Annexure P-11).

In view of the above, the present writ petition is dismissed. 7.

Pending application(s), if any, shall also stand(s) disposed of.
