******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 99 dated 17.05.2017 registered for the offence punishable under Section 15 of Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 171, 420, 468, 471 of Indian Penal Code (for short-IPC) added later on, at Police Station Gobindgarh Mandi, District Fatehgarh Sahib. Heard.

Learned State counsel submits that petitioner was not arrested at the spot. The police after completion of investigation, has already presented the challan in Court.

In view of submission of learned State counsel but without expressing any opinion on the merits of the case, this petition is allowed and order dated 02.06.2017 is made absolute subject to the following terms:- Sachin Mehta 2017.09.13 12:09 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH

CRM-M-20517-2017 -2- (i) As the challan has been filed, petitioner will surrender before the trial Court and apply for regular bail; (ii) on moving the application for regular bail, the trial Court will decide the application in accordance with law on the basis of material on file;

(iii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iv) that the petitioner shall not leave India without the prior permission of the Court.
