JASWANT SINGH, J (Oral) Prayer is for grant of regular bail in case FIR No.159 dated 06.11.2015 under Sections 15/61/85 of the NDPS Act, P.S City Dhuri, District Sangrur.
As per allegations, the petitioner along with his coaccused was found to be in conscious possession of 56 kg of poppy husk while sitting on a bag near cremation ground. It is submitted by learned counsel for the petitioner that the petitioner is in custody since November 2015 and the alleged recovery is marginally commercial. That apart, the petitioner is not involved in any other criminal case. Learned State counsel, on instructions from ASI Paramjit Singh, submits that the matter is still under investigation, however, he is unable to refute the contention
CRM-M-2147 of 2016 #2# regarding custody period and the involvement of the petitioner in any other case.
Without commenting upon merits of the case and keeping in view the facts of the present case and the fact that the trial is not going to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars any longer.
Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Sangrur. January 27, 2016 (JASWANT SINGH) manoj JUDGE
