Rajender Kumar And Another v. State Of Punjab And Others
TAPINDER SINGH MANN 2016.07.08 17:12 IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH.
Cr. Misc. M 21493 of 2016 Date of decision: 8.7.2016 Rajender Kumar and anr Petitioner vs.
State of Punjab and ors Respondent
Present:
Mr. Abhinav Gupta, Advocate.
M.M.S.BEDI,J.
The petitioners have levelled allegations against respondent No.3 DSP, Rampura Phul alleging that in view of complaint having been filed by Dheeraj Bansal against son-in-laws of the petitioners, alleging that he has sold gold to them against some cheques, which have been dishonoured, there is an apprehension of their false implication. I do not find any ground to interfere in exercise of powers u/s 482 Cr.P.C because petitioner No.1 appears to have approached the Sessions Court, Bathinda for blanket bail, in which a direction has already been issued to the police that three days notice will be given to him in case a criminal case is registered against him in an inquiry, which is pending before DSP, Rampura Phul. It is clarified that the order passed on 30.6.2016 by the Additional Sessions Judge, Bathinda will remain operative qua the rights of the petitioners in context to the complaint filed by Dheeraj Bansal and the order will remain operative for a period of six months only in the circumstances, mentioned in the petition.
Disposed of with the above observations.
